Please be advised that all bidders must read and accept the Terms and Conditions of this sale.

BIDDING INSTRUCTIONS/TERMS OF SALE:  When bidding on any lot offered by Toys of Times Past (via Internet, Phone or Email) the bidder indicates acceptance of the following Terms of Sale:

REGISTRATION: All bidders must pre-register with Toys of Times Past Auctions to receive a Bidder ID prior to the last day of the auction. Please register online at www.toysoftimespast.com or call 216-218-1971. A credit card number is required for bidder registration.

BIDDING INSTRUCTIONS: You may bid as high as you want over the minimum bid. VIA INTERNET/WEBSITE: Bidding starts as soon as the online catalog is posted on the website (usually 3 weeks prior the end of the auction). VIA EMAIL: Email bidding starts as soon as the printed catalog is received or the online catalog is posted. Please email bids to: bidding@toysoftimespast.com VIA PHONE: 10:00 am– 7:00 pm est for the first two weeks of auction; 10:00 am—9:00 pm est on the last week of the auction and 12:00 noon—end on the last day of auction. VIA MAIL: Please submit completed and signed Bid Form. Mail and Email bids can be confirmed by calling 216-218-1971.

LAST NIGHT BIDDING INSTRUCTIONS: Beginning at 11:00 pm est, bidding will continue in 15 minute increments until no bids are received within that 15 minute increment. If a bid is placed, the auction is extended for an additional 15 minutes. When a 15 minute period passes with no bids placed, the auction is over. For example, we received a bid at 2:00 am and no more bids are received by 2:15 am, then the auction is completed.

CALL BACKS: Call backs begin at 11:00 pm est on the last night of the sale and are available upon request. You must be the high bidder on the item and the current bid must be $750.00 or more.

BUYERS PREMIUM: 15% buyers premium will be added to all purchases paid for with MasterCard or Visa. A 3% discount will be applied to all purchases paid for with Cash, Check or Money Order (discounted to 12%).

SALES TAX: Ohio residents must pay Ohio sales tax unless you have an Ohio sales tax exemption number. You must fill out a Sales Tax Exemption form and submit a copy of your Department of Taxation Tax Exemption License. If purchase is shipped out of the State of Ohio, the purchase is exempt from Ohio sales tax. Bidders picking up items from out of state are subject to 7.75% Ohio sales tax.

PAYMENT: Visa, MasterCard, Cash, Check or Money Order are accepted. All checks will be held for 10 business days prior to shipping the purchase. Invoices with be sent within 7-10 days after the close of auction. Payment in full must be received within 14 days after receiving invoice.

SHIPPING: All items are shipped fully insured and the buyer is responsible for the insured shipping cost. Although we take great time and care in packing, if an item is damaged in shipment, please notify us immediately. All packing material, shipping boxes and damaged item must be kept, otherwise we will not be able to process an insurance claim. We can not be held responsible for making a claim if these instructions are not followed.

RETURNS: A refund of the purchase price minus all shipping costs will be issued only if the item was grossly misrepresented. Buyer must notify us of any problem within 3 days after receiving the item. If the return is authorized, the item must be returned with full insurance so that it arrives in our possession within 7 days of the return authorization. The returned item must be received in the same condition as originally sent; otherwise, this policy is void.

Toys of Times Past has the right to refuse any bid from anyone at any time for any reason.

Toys of Times Past is not responsible for any errors in executing any mail, email, phone or fax bid and is providing this service for the convenience of the customers only. Toys of Times Past is not responsible for typographical errors or omissions in online catalog.

Toys of Times Past assumes no liability for withdrawing any lot and has the right to pull any lot at any time prior to the end of the auction.

If there is a system failure or failure in the auction bidding process, Toys of Times Past reserves the right to reschedule the auction end-date to the next Friday following the originally scheduled end-date.

ABREVIATIONS: M=Mint (Flawless condition/Like new); NM=Near Mint (Very slight playwear and/or box storage wear) ; EX+= Excellent Plus (May show slightly more wear than NM but still retains bright, glossy finish); EX=Excellent (Shows light playwear and scratches); VG=Very Good (Shows heavier playwear, more defects & fading but still displayable) , G=Good (Obvious overall wear with possible missing parts), F=Fair (Extensive damage, wear and possible missing parts); BO=Battery Operated; BORC=Battery Operated Remote Control; FR=Friction; HBP=Hanna Barbera Productions; KFS=King Features Syndicate; OB=Original Box; PS=Pressed Steel; WDP=Walt Disney Productions; WS=Wingspan; WU= Windup.

In publishing this catalog, Toys of Times Past Auctions has tried to accurately describe all items being sold. All items are sold AS IS - WHERE IS. It is the bidder’s responsibility to judge condition. If you have questions, please ask. No statement in this catalog shall be deemed to be a warranty or representation of the items being sold and Toys of Times Past will not assume liability with respect to age, condition, rarity, provenance or historical relevance of the items being sold. Any agent under the employ of any bidder is bound by the terms of sale as stated in the online catalog and any relevant documents.

Title to all merchandise shall pass to the highest bidder at conclusion of bidding. The purchaser is fully responsible once title has been passed. Storage and insurance charges shall accrue at the rate of 2% of the selling price per month after 30 days.
